Permeable paving and the SuDS rules explained
In England, a new or replacement front garden surface over five square metres needs planning permission if it is impermeable and drains to the road. Permeable paving, or drainage to a lawn or border, keeps the work inside permitted development. That single rule is why most new front drives are now built to soak away rather than run off.
Where the rule came from
Front gardens used to drain into the road. Enough of them were paved over during the 1990s and 2000s that surface water ran straight into sewers built for far less, and the flash flooding that followed pushed the government to change permitted development rights in 2008. The rule has been in force ever since, and it is enforced through building the surface correctly rather than through anyone knocking on the door.
What the rule actually says
- Under five square metres: no permission needed, whatever the surface.
- Over five square metres and permeable: no permission needed.
- Over five square metres, impermeable, but draining to a lawn, border or soakaway within the property: no permission needed.
- Over five square metres, impermeable, draining to the highway: planning permission required.
Note that it is the drainage destination, not the material, that decides it. A block paved drive that falls into a gravel border is fine. The same drive falling to the kerb is not. Listed buildings and conservation areas, common enough around Yarm High Street, Norton Green and parts of Saltburn, carry their own extra controls, so check with the council before ordering materials.
What SuDS means in a front garden
Sustainable drainage systems is a broad term for dealing with rainfall where it falls instead of piping it away. In a domestic front garden it usually means one of three things: a permeable build that soaks into the ground, a permeable build that stores water in the stone and releases it slowly through an outlet, or a conventional surface graded towards a soakaway, rain garden or planted border. On Teesside's boulder clay the storage-and-release version is the common answer, because infiltration alone is slow.
How a permeable build differs
The visible change is the joint: wider, filled with clean angular grit rather than sand. The important change is below, where open-graded stone replaces the fines-heavy Type 1 used under standard paving. That open structure both carries the load and stores the water, so the dig is deeper, commonly 350mm to 450mm, and the extra cost lands mostly in excavation, muck away and stone. Expect £80 to £120 per square metre laid, against £60 to £100 for a standard block build. The permeable paving page sets out the layers and the cost guide puts the premium in context.
Practical checks before you commit
- Ask the contractor to state which of the three drainage systems the quote is priced on, because the depth of stone follows from it.
- Ask where roof water goes. Downpipes discharging onto a new drive change the whole calculation.
- Check the finished level against the damp proof course, aiming for at least 150mm clear.
- Check whether a vehicle crossing is needed, since the dropped kerb is a separate council application handled through the highway authority and often has the longest lead time in the job.
- Keep the paperwork. A written specification showing a permeable build is what proves compliance if it is ever questioned at sale.
